By accessing or using Fuxux ("Service") at fuxux.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Fuxux is a social media scheduling and publishing platform that allows users to manage and post content across multiple social media networks from a single dashboard, with AI-assisted caption generation.

3. Eligibility and Account Responsibilities

You must be at least 13 years old to use the Service.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate and complete information when creating an account.

4. Acceptable Use

You agree not to use the Service to:

Post spam, misleading, or deceptive content.
Violate the terms of service of any connected social media platform.
Infringe on any third party's intellectual property rights.
Harass, threaten, or harm other individuals.
Attempt to reverse engineer or compromise the security of the Service.

5. Subscriptions, Billing, and Taxes

Fuxux offers free and paid subscription plans. Paid plans are billed monthly. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law. You are responsible for any taxes, duties, or similar charges related to your use of the Service.

6. Content Ownership

You retain full ownership of all content you create and publish through Fuxux. By using the Service, you grant Fuxux a limited license to store and transmit your content solely for the purpose of operating the Service.

7. Third-Party Platforms and Integrations

Parts of the Service depend on third-party platforms and providers (for example, social networks, hosting, payments, and AI providers). We do not control these third parties and are not responsible for their outages, policy changes, or API restrictions. You are responsible for ensuring your use of those platforms complies with their own terms and policies.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party platform outages, or technical issues may occasionally affect service availability.

9. Limitation of Liability

Fuxux is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Fuxux shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.

10. Indemnification

You agree to indemnify and hold Fuxux harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may terminate your account at any time from the Settings page.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Any dispute arising from or related to these Terms or the Service shall be submitted to the competent courts of Madrid, Spain, unless mandatory consumer protection law in your country of residence provides otherwise.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the app. Continued use of the Service constitutes acceptance of the revised Terms.
